DTC Segment Terms

The following terms apply if Supplier is providing Data pertaining to individuals in the U.S. in the form of “DTC Segments” (direct to consumer segments pertaining to users) to TD pursuant to The Trade Desk Data Supplier Agreement – Targeting Segments. All capitalized terms not otherwise defined herein shall have the meanings set forth in The Trade Desk Data Supplier Agreement – Targeting Segments.

1. Health-Related Data. “Health-Related Data” includes any data about individuals directly related to health, medical conditions, diagnoses, or the use of prescription treatments and medications, including data related to physical or mental health statuses, whether past, present or future. Health-Related Data does not include PHI (protected health information governed by HIPAA), preventative health therapy data (e.g., vaccines, testing, screening, and prevention data), or Modeled Data.

2. Modeled Data. “Modeled Data” is defined as data that is the result of a modeling process where the output of such process (a) excludes the seeds and any data related to the seeds and (b) is associated only with individuals about whom no knowledge or evidence exists to suggest that they have a particular condition, such that the output is neither PHI nor Health-Related Data.

3. Restrictions. Without limiting Supplier’s obligations under any applicable law, Supplier shall not introduce or cause TD to process any information containing: a. Health-Related Data, provided however that Modeled Data is allowed provided that the audience is not based on knowledge, evidence, or inference that individuals have a health condition; b. PHI; c. IDs from Washington and/​or Nevada.

4. Changes/​Updates. TD reserves the right to change or modify these DTC Segment Terms at any time as reasonably necessary in its sole discretion.
